Jakarta, Legal Literacy - A member of the Indonesian House of Representatives from the PDI-P faction, Masinton Pasaribu, believes that discussions regarding the possible use of the right of inquiry to investigate alleged fraud in the 2024 General Election will be held in parliament by various political parties. According to him, the right of inquiry is considered a political strategy that can be used to prove alleged irregularities in the 2024 Presidential Election.
Masinton expressed this opinion in the "Satu Meja The Forum" program broadcast by Kompas TV on Wednesday evening, February 28, 2024. He also emphasized that the idea of using the right of inquiry did not only come from his current party, because personally, he had supported the proposal for the DPR to consider using the right of inquiry since the end of October 2023.
Right of Inquiry to the Constitutional Court
At that time, Masinton, a member of the DPR from the PDI-P faction, was the first to propose that the DPR use the right of inquiry to investigate alleged ethical violations experienced by the former Chief Justice of the Constitutional Court (MK) Anwar Usman regarding decision number 90/PUU-XXI/2023 concerning the age limit for presidential and vice-presidential candidates (capres-cawapres). "As a member of the Indonesian House of Representatives, I raised this issue immediately after a serious ethical violation occurred in the Constitutional Court. At the end of October before the vote, I had already voiced the inquiry proposal. Why? Because I realized that this was a major problem in the stages leading up to the election," said Masinton.
According to a politician from PDI-P, the current situation is seen as originating from a decision of the Constitutional Court (MK) which was highlighted as controversial. As a result, the Constitutional Court's Honorary Council (MKMK) concluded that Anwar Usman, who is also a relative of presidential candidate number 2, Gibran Rakabuming Raka, had violated ethics related to the MK's decision. The politician said that the current problem is the "tip of the iceberg", with the root of the problem traceable to the MK's previous decision. He emphasized the importance of recognizing weaknesses in the regulatory system and considering the series of events leading up to the voting day in the 2024 General Election, which was considered full of problems.
