JAKARTA, LEGAL LITERACY – The General Elections Commission (KPU), as the Respondent in the election result dispute, stated that Sri Sulartiningsih, a candidate for the Regional Representative Council (DPD RI) from North Kalimantan Province, had made a mistake in comparing vote count data based on tiered recapitulation. This was conveyed by the KPU in a hearing led by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsih, in case number 08-24\/PHPU.DPD-XXII\/2024.
“Based on the Petitioner's argument, the Petitioner made a mistake in comparing data, because the Petitioner compared the C Plano version of the Petitioner with the D Result Regency\/City,” said M. Faiz Putra Syanel, Legal Counsel for the Respondent at the Hearing held in Panel Room 3, Monday (13\/05\/2024).
The KPU emphasized that if the Petitioner wants to compare C Plano data (Petitioner's version), the data should be compared with D-Result data at the Sub-district Level, not with D-Result at the Regency\/City Level. This is because the substance of the D-Result at the Sub-district Level contains attachments regarding vote acquisition data at the polling stations in each Village\/Kelurahan, so that a data comparison can be clearly seen. However, it is different from the D-Result at the Regency\/City Level, which of course does not present data up to the TPS Level, but only presents the substance of vote acquisition at the Sub-district Level, not the TPS.
According to the KPU, because the Petitioner compared C Plano data with D-Results at the Regency\/City Level, the Petitioner's argument is an argument that cannot be compared and is not in accordance with the tiered recapitulation procession in Indonesia.
Furthermore, the KPU stated that although the Petitioner did not explain in detail the locus of the problem argued by the Petitioner, the Respondent has found a specific locus related to the difference in calculations argued by the Petitioner. Namely, it is located at TPS 001 Sumantipal Village, Lumbis Pansiangan District, Nunukan Regency, North Kalimantan Province. By looking at the data comparison using a comparable comparison, in this case the Petitioner's version of C Plano, the Respondent's C-Result, and the Respondent's Sub-district D-Result Attachment, it can be seen that there is no difference between the recapitulation process that occurred at the TPS level to the Sub-district.
