JAKARTA, LEGAL LITERACY - The Constitutional Court (MK) of the Republic of Indonesia held a preliminary hearing for the General Election Result Dispute (PHPU) case for prospective members of the DPRD (Regional People's Representative Council) of the Deyai Electoral District (Dapil) 3 today, Monday, April 29, 2024. The case with number 106-02-01-36/PHPU.DPR-DPRD-XXII/2024 was filed by Agusten Yuppy, a candidate for DPRD member of Deyai Regency Dapil 3 from the National Awakening Party (PKB), who argued that there was alleged manipulation of votes by the KPU (General Elections Commission) of Deyai Regency.

Alleged Changes to PKB Vote Results in Deyai Regency

The preliminary hearing was presided over by Constitutional Justice Arief Hidayat, with members of the panel of justices Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsih. In his petition, the Petitioner, represented by his attorney, Subani, argued that the KPU of Deyai Regency allegedly changed the results of PKB's vote acquisition so that C. Hasil Plano (Plano Result C) and D. Hasil (Result D) were not in accordance with the recommendations from the Regency Bawaslu (Election Supervisory Body) which did not coordinate with the PPK (Subdistrict Election Committee) of Kapiraya District.

The Petitioner claims that the correct acquisition of PKB votes based on C. Hasil Plano and D. Hasil of Deyai Regency 3 is 2,034 votes.

The Petitioner's Objection Was Not Responded to by the KPU

The Petitioner, through his attorney, revealed that when conducting a vote recapitulation meeting at the KPU of Deyai Regency, his team had officially submitted a protest or objection and requested the use of the Noken voting system that had been agreed upon. However, the Deyai KPU ignored the objection.

Petitioner's Demands

The Petitioner requests the Court to grant his petition in its entirety, annul the General Election Commission Decree Number 360 of 2024, and determine the correct vote acquisition results according to the Petitioner for filling the membership of the DPRD of Deyai Regency Electoral District (Dapil) 3, which is 2,034 votes.
