Presidential Election Result Dispute to be Tried by 8 Constitutional Justices
Constitutional Court (MK) will accept registration of general election result disputes (PPU) after the General Election Commission (KPU) announces the national vote recapitulation results on March 20, 2024. Registration for presidential election result disputes will be open for three days after the KPU determines the vote acquisition, while registration for legislative election result disputes will be open 72 hours after the KPU announces the results.
Based on Constitutional Court Regulation Number 5 of 2023 concerning the Stages, Activities, and Schedule for Handling PPU Cases of Members of the DPR, DPD, and DPRD, as well as Presidential Elections, the Constitutional Court will receive applications for presidential election result disputes through the e-Constitutional Case Registration Book (e-BRPK) on March 25, 2024. The first hearing will be held no later than four days after the application is registered in the e-BRPK. In accordance with PMK No. 5/2023, the first hearing for presidential election result disputes will take place on March 28, 2024. After that, the Constitutional Court will hold an evidentiary hearing involving hearing witnesses, expert testimony, and examining other evidence.
When asked when the presidential election dispute decision would be read out, Suhartoyo admitted that he had forgotten. "Basically,on time, it will be decided in 14 days. But the exact date depends on what day it starts," he said.
The 2024 Presidential Election Dispute will be handled by eight justices of the Constitutional Court (MK). Anwar Usman, one of the Constitutional Court justices, was not included due to a potential conflict of interest. The vice presidential candidate number 3, Gibran Rakabuming Raka, is Anwar Usman's nephew, so it is feared that it will affect his decision in handling the Presidential Election dispute.
The information was confirmed by Suhartoyo when asked about the constitutional justices who would handle the dispute. He stated that all justices, except those who have been determined to be unable to handle the case.
