Alleged Bribery Corruption Case by the Head of Basarnas

The alleged bribery case involving the Head of Basarnas for the 2021-2023 period, Henri Alfiandi, and the Administration Coordinator (Koorsmin) of Basarnas, Lt. Col. Adm Afri Budi Cahyanto, has sparked controversy in its handling. Coordination between the KPK and the TNI in addressing alleged corruption in the procurement of goods and services within Basarnas has come under scrutiny after the KPK named two active military soldiers as suspects.

In this regard, the Commander of the Military Police Center (Danpuspom) TNI, Rear Marshal Agung Handoko, stated that the authority to name suspects against active TNI soldiers in alleged violations of the law lies within the realm of military investigators. Agung explained that the military has the authority to name active TNI soldiers as suspects, while the KPK has the authority to handle this case in the general environment.

The KPK has coordinated with Puspom TNI regarding the handling of the alleged bribery case in the procurement of equipment for detecting victims of rubble for the 2023 Fiscal Year at Basarnas RI. KPK Deputy Chairman Alexander Marwata claimed that his party had invited Puspom TNI investigators to conduct a case expose together. From the results of the expose, Puspom TNI investigators have presented sufficient evidence regarding the case.

According to the KPK Law Article 42, the KPK has the authority to coordinate and control investigations, prosecutions, and prosecutions of criminal acts of corruption committed by persons subject to military and general courts. This confirms that the KPK can handle the law enforcement process against military soldiers involved in the case.

Furthermore, if we look at Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, in Article 1 number 2, specifically letter b, which states that:
