Legal Literacy - The government is drafting a Government Regulation Draft (RPP) on State Civil Apparatus (ASN) Management as a step to implement Law Number 20 of 2023 concerning ASN. This RPP will regulate leave granted to husbands when their wives give birth or experience a miscarriage.
Leave is the Right of Male ASN
Minister of Administrative and Bureaucratic Reform (PANRB) Abdullah Azwar Anas stated that this leave right will be part of the rights of male ASN guaranteed by the state.
"The government will grant leave rights to husbands whose wives give birth or have a miscarriage. Leave to accompany a wife giving birth is a right of male ASN that is regulated and guaranteed by the state," said Minister of Administrative and Bureaucratic Reform (PANRB) Abdullah Azwar Anas in a written statement, Wednesday (13/3/2024).
Previously, there were no specific provisions regarding leave for male ASN in this situation, only maternity leave was regulated for female ASN. This RPP is planned to be completed in April 2024 after involving input from various parties, including DPR.
"The leave right is the aspiration of many parties. Currently, the government is asking for input from stakeholders, including the DPR, regarding this matter," said Anas.
Several Countries Have Implemented Leave for Husbands Whose Wives Give Birth
Anas emphasized that leave rights for husbands whose wives give birth or have a miscarriage have been implemented in several countries and multinational companies with varying durations, ranging from 15 days to 60 days.
However, in the RPP currently being drafted, how long the leave will be granted is still in the discussion stage with stakeholders and will be regulated in detail in a Government Regulation (PP) and a Regulation of the Head of the State Civil Service Agency (BKN).
"The length of the leave is being discussed with related stakeholders which will be technically regulated in the Government Regulation and the Regulation of the Head of BKN," he said.
Anas also highlighted the importance of the father's role in accompanying his wife during childbirth, including in the early postpartum phases. This initiative is in line with the direction from President Jokowi to improve the quality of human resources from an early age.
"In accordance with President Jokowi's direction, this is one of the initiatives for us to continue to strive to encourage improving the quality of human resources from an early age," said Anas.
