JAKARTA, LEGAL LITERACY - The Constitutional Court of the Republic of Indonesia held a preliminary hearing regarding the General Election Results Dispute (PHPU) case for prospective members of the DPR RI for the Central Papua Electoral District filed by the Great Indonesia Movement Party (Gerindra) on Monday (29/04/2024) morning. The petition, registered under case number 91-01-02-36/PHPU.DPR-DPRD-XXII/2024 seeks the annulment of the General Election Commission Decree Number 360 of 2024 and the implementation of a Re-Vote (PSU).

Allegations of Stolen Noken Votes

In the preliminary hearing led by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justice Anwar Usman and Constitutional Justice Enny Nurbaningsing, the petitioner, through his attorney, Subadria, argued that the noken system in Central Papua had been tainted by structured vote fraud practices. Votes that had been tied using the noken system in each district were reported missing during the sub-district level plenary session. The recapitulation results at the sub-district level then underwent drastic changes at the district level, and so on up to the provincial level. At the provincial level recapitulation plenary session, the votes obtained at the district level suddenly disappeared.

Allegations of Violations of Administrative Obligations

In addition, the petitioner in its lawsuit alleges violations of the procedures for voting and counting votes in Central Papua, especially in areas that use the Noken/Ikat system. This violation is alleged to have occurred due to the failure to fulfill the administrative obligations stipulated in KPU Decree Number 66 of 2024.

Petitioner's Demands

The petitioner requests the Constitutional Court to grant its petition in its entirety, annul General Election Commission Decree Number 360 of 2024, and order the General Election Commission of the Republic of Indonesia to implement a Re-Vote in the electoral districts of Puncak Jaya Regency, Paniai Regency, Puncak Regency, Dogiyai Regency, Intan Jaya Regency, and Deiyai Regency for the filling of prospective Members of the DPR RI for the Central Papua Electoral District.
