Ferdy Sambo's Case

Ferdy Sambo is the former Head of the National Police's Profession and Security Division who planned the murder of his own adjutant, Yoshua. Until the end of the trial, the motive for planning the murder was not clearly explained. Sambo and Putri only claimed that the background to the murder was sexual harassment. However, many experts doubt their statements. Even so, murder is prohibited even if the victim is said to be a perpetrator of sexual violence. Moreover, the murder was committed by a person who served as the police of the police. Not only that, Ferdy Sambo was also prosecuted for criminal act ofobstruction of justice in the investigation of the murder case.

What is obstruction of justice?

Obstruction of justice is an intentional act to obstruct the justice process or hinder the duties of law enforcement officials in carrying out their duties. This action can be in the form of an act that influences, falsifies, or conceals evidence, provides false information, or obstructs a person who is carrying out legal duties. In some countries, obstruction of justice can be subject to severe penalties.

In Indonesia, obstruction of justice can be subject to punishment based on Law Number 8 of 1981 concerning the Criminal Code Criminal Code (KUHP). In the Criminal Code, obstruction of justice can be imposed under Article 221 or 223 of the Criminal Code.

Ferdy Sambo's Indictment

In an indictment as thick as 97 pages, Sambo was charged with two articles. In the first indictment, the prosecutor charged the former Head of the National Police's Profession and Security Division with Article 340 subsidiary to Article 338 and Article 55 of the Criminal Code. In this indictment, Sambo is accused of being involved in the premeditated murder of Brigadier J.

In the second indictment, Sambo was charged with committing acts of obstructing law enforcement or obstruction of justice because he removed CCTV camera evidence at the scene of Bripka J's murder. Sambo was charged with violating Article 49, Article 48 paragraph 1 juncto Article 33, and Article 32 paragraph 1 juncto Article 55 of the Criminal Code. In addition to Article 221 paragraph 1, the prosecutor also used Article 223 juncto Article 55 of the Criminal Code.

Ferdy Sambo's Demands

The prosecutor demanded that Ferdy Sambo be sentenced to life imprisonment on Tuesday, January 17, 2023. Sambo was considered to have violated the primary indictment, namely Article 340 of the Criminal Code juncto Article 55 Paragraph (1) 1 of the Criminal Code concerning premeditated murder. In addition, Sambo was considered to have violated the second primary indictment, namely Article 49 juncto Article 33 Law Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE) juncto Article 55 Paragraph (1) 1 of the Criminal Code.

Ferdy Sambo's Verdict

On Monday (13/02) at the South Jakarta District Court, Ferdy Sambo was sentenced to death for the premeditated murder of Bripka Yosua and obstructing the legal process.

"The defendant Ferdy Sambo S.H. S.I.K. M.H. has been legally and convincingly proven guilty of committing a criminal act by participating in premeditated murder and without the right to jointly commit acts that resulted in the malfunctioning of the electronic system.

The Head of the Panel of Judges, Wahyu Iman Santosa, sentenced the defendant to death. The verdict caused a stir in the courtroom.(ai)
