Verdict of the Constitutional Court

Chief Justice of the Constitutional Court Suhartoyo read out the Verdict which stated that the application of Petitioner II could not be accepted and rejected the application of Petitioner I in its entirety. Previously, the Petitioners, who are people with partial color deficiencies, often experienced safety threats while driving on the highway, especially in coverage activities. They felt the Articlea quodid not provide equal treatment, thus creating safety threats and discrimination. The Petitioners argued that the rules regarding Traffic Light Signaling Devices (APILL) which only rely on color are a form of indirect discrimination, only benefiting road users with normal vision. The existing APILL only relies on red, yellow and green color codes, which cannot be interpreted properly by color blind drivers. This condition puts them in a vulnerable position and potentially violates the rules unintentionally due to their inability to distinguish traffic signal colors.
