JAKARTA, Legal Literacy — The Speaker of the House of Representatives received a letter from Commission III containing a review of the alleged abuse of authority by the Constitutional Court (MK) judges regarding the decision to separate national and local elections. This document will be processed according to applicable mechanisms. Therefore, the letter has the potential to be the basis for further steps, including the evaluation of constitutional judges.
Delivered in the Plenary Session
The letter was read by Deputy Speaker of the House Adies Kadir at the 25th Plenary Session of the House of Representatives for the IV Session Period of the 2024–2025 Session Year, Thursday (24/7/2025), at the Parliament Complex. On that occasion, he mentioned the letter number of Commission III: B/799/PW.0102/VII/2025 dated July 23, 2025. "The leadership of the council has received a letter from Commission III of the DPR regarding the Constitutional Court," said Adies. After that, he asked for the approval of the forum. All factions immediately approved the contents of the letter.
Further Study of the Constitutional Court Decision 135/PUU-XXII/2024
Adies emphasized that this letter is a follow-up to Commission III's review of the Constitutional Court Decision Number 135/PUU-XXII/2024. The decision separates the holding of national elections and local elections starting in 2029. Specifically, the study assesses two things: the possibility of constitutional violations and indications of abuse of authority. When asked about the possibility of evaluating judges, Adies did not rule out the possibility. "It will still be discussed," he said.
The Attitude of the DPR Leadership
DPR Speaker Puan Maharani ensured that the input from Commission III would be processed procedurally. "The study and review are given to the leadership to be discussed according to the existing mechanism," she said. Thus, the entire process still follows the internal rules of the DPR.
Review Process in the Spotlight
Commission III's review was born from a public hearing (RDPU) on July 7, 2025. At the meeting, three figures were asked to provide legal and constitutional views: Taufik Basari, Patrialis Akbar, and Valina Singka Subekti.
Contents of the Decision and Controversy
Constitutional Court Decision Number 135/PUU-XXII/2024, read out on June 26, 2025, stipulates that national elections (president, DPR, DPD) will be held first. Then, local elections (DPRD province/regency/city and regional elections) are held at least two years and a maximum of two and a half years after the inauguration of the president-vice president or members of the DPR and DPD.
Although final and binding, this decision has been met with rejection. Several political parties have expressed objections and are reluctant to accept it.
Authority to Evaluate State Officials
In addition, public attention is focused on the authority of the DPR which was expanded through the revision of DPR Regulation Number 1 of 2020 concerning the Rules of Procedure. The revision allows the DPR to conduct periodic evaluations of state officials elected through plenary sessions—including constitutional judges. Through this rule, the DPR can issue dismissal recommendations if necessary.
