JAKARTA, Legal Literacy – Commission III of the Indonesian House of Representatives is scheduled to hold a fit and proper test for candidates for constitutional court (MK) judges to replace Arief Hidayat on Wednesday (20/8/2025). This replacement is being carried out because Arief will enter retirement age in February 2026.

Deputy Chairman of Commission III of the DPR RI Ahmad Sahroni said that his party had received a notification letter from the MK regarding the replacement. “Later fit and proper probably tomorrow (Wednesday), if I'm not mistaken,” he said when met at the Parliament Complex, Senayan, Tuesday (19/8/2025).

However, Sahroni was not willing to reveal who the candidate would be tested. He only emphasized that Arief's replacement was a figure who was considered better. “Pak Arief is good, it will be even better later. More, less, minus, it's normal,” he said.

Meanwhile, Deputy Chairman of the DPR RI Adies Kadir emphasized that every constitutional justice who enters retirement must be replaced immediately, according to the mechanism that runs in Commission III. “I am sure that my friends in Commission III understand very well what the replacement process is like,” he said.

For information, the rules regarding the retirement age of constitutional judges are stated in Article 23 of Law Number 7 of 2020 concerning the Constitutional Court. The article states that constitutional judges are dismissed when they reach the age of 70 years. In addition, Article 6 Paragraph 2 of Constitutional Court Regulation Number 4 of 2012 requires the Constitutional Court to send notification to the DPR no later than six months before a judge reaches retirement age.

The current ranks of constitutional judges consist of Suhartoyo (65), Anwar Usman (68), Arief Hidayat (69), Saldi Isra (56), Enny Nurbaningsih (63), Daniel Yusmic Pancastaki Foekh (60), Guntur Hamzah (60), Ridwan Mansyur (65), and Arsul Sani (61).
