Suspects' Guarantees and Commitments in the Legal Process
In an effort to convince the South Jakarta District Attorney's Office, the legal counsel team not only relied on arguments regarding the compliance and good faith of their client but also included guarantees from the family and the legal counsel team itself. The wife of Roy Suryo and the child of Doctor Tifa provided written guarantees, affirming the readiness and commitment of both suspects to always be present whenever a trial is held. The presence of these guarantors is one of the factors considered by the prosecutor's office in deciding whether detention is necessary or not. A guarantor serves as a party morally and legally responsible if the suspect fails to fulfill their obligations during the trial process.
In addition to guarantees from family, the advocates within the legal counsel team also collectively provided guarantees. This demonstrates full support from the legal team, who are ready to ensure that Roy Suryo and Doctor Tifa will be cooperative throughout the ongoing legal process until the final verdict. In the request letter, the legal counsel team also explicitly stated their belief that their clients will not obstruct the course of the trial. This commitment is reinforced by the assertion that Roy Suryo and Doctor Tifa will not flee, which is one of the primary concerns of prosecutors in deciding on detention. Thus, this request for a suspension of detention is supported by a combination of legal arguments regarding the absence of objective reasons for detention and concrete guarantees from trusted parties.
