JAKARTA, LITERASIHUKUM.COM — The Corruption Eradication Commission (KPK) has again detained a suspect in the alleged hajj quota corruption case. After previously detaining the former Minister of Religious Affairs Yaqut Cholil Qoumas, the KPK is now detaining his former special staff, Ishfah Abidal Aziz alias Gus Alex, after an examination at the KPK's Merah Putih Building, Jakarta, Tuesday (17/3/2026).
The detention of Gus Alex reinforces that the KPK is now taking the hajj quota case to a more serious phase. Previously, the anti-corruption agency had indeed determined the two main suspects, namely Yaqut Cholil Qoumas and Ishfah Abidal Aziz alias Gus Alex, in the alleged corruption case of determining quotas and organizing the hajj pilgrimage in 2023–2024. The KPK initiated the investigation of this case on August 9, 2025, then announced the determination of the two suspects on January 9, 2026.
Gus Alex was detained five days after Yaqut first entered the KPK detention center. On March 12, 2026, the KPK detained Yaqut after questioning him as a suspect, not long after his judicial review petition was rejected by the South Jakarta District Court. At that time, Yaqut denied receiving money from the hajj quota case and stated that his policy was solely for the safety of the pilgrims.
KPK Suspects Gus Alex Played an Active Role in Discretion and Quota Distribution
The KPK previously explained that the reason for naming Yaqut and Gus Alex as suspects was not only because the distribution of additional hajj quotas allegedly deviated from the rules, but also because there was an alleged flow of money from Special Hajj Pilgrimage Organizers (PIHK) or travel bureaus to individuals in the Ministry of Religious Affairs. For Gus Alex, the KPK stated that his role was quite active, starting from the process of issuing discretion to the distribution of additional hajj quotas.
In the construction built by the KPK, this case originated from the distribution of 20,000 additional hajj quotas from the Government of Saudi Arabia in the 2024 hajj season. At that time, the additional quota was divided 50 percent for regular Hajj and 50 percent for special Hajj, 10,000 quotas each. In fact, the KPK considers the distribution not in accordance with applicable regulations. Based on Article 64 of Law Number 8 of 2019 concerning the Implementation of Hajj and Umrah, the portion of the special Hajj quota is set at 8 percent, while 92 percent is allocated for regular Hajj.
The KPK has also stated that this case was built with the construction of state financial losses. At the beginning of the investigation, the state loss figure was said to reach more than Rp1 trillion. However, after receiving an audit from the BPK, the KPK in early March 2026 stated that the state loss in the Hajj quota case reached approximately Rp622 billion.
Gus Alex's Detention Marks the Strengthening of the Enforcement Stage
Before being detained, Gus Alex had been questioned several times by KPK investigators. In January 2026, he was questioned regarding the calculation of state losses and alleged money flows in the Hajj quota case. At that time, the KPK emphasized that Gus Alex was one of the suspects whose role was being investigated. The KPK has also extended the overseas travel ban on Gus Alex and Yaqut until August 12, 2026, indicating that this case is deemed to require further investigation.
With Gus Alex's detention, the public's focus is now no longer solely on the polemic of quota distribution, but rather on proving whether the discretionary policy was indeed used as an entry point for irregularities that harmed the state and benefited certain parties. If the KPK's charges are later proven in court, this case will become one of the most prominent examples of how administrative policies in the religious service sector can turn into corruption cases when power, discretion, and money flows meet in a single chain of events.
