JAKARTA, Legal Literacy - The Chairman of Commission III of the House of Representatives of the Republic of Indonesia, Habiburokhman, has requested that ED—a father in Pariaman, West Sumatra—not be sentenced to death or life imprisonment. ED is suspected of killing F (38), a man accused of sexually assaulting his 17-year-old child.
Habiburokhman emphasized the importance of a sense of justice in law enforcement. He stated that Commission III empathizes with ED, although the act of taking a life cannot be justified.
Reference to the New Criminal Code: Excusable Defense Exceeding Limits and Consideration of Motives
According to Habiburokhman, law enforcement officials need to investigate the psychological conditions underlying ED's actions, especially the alleged mental shock after learning that his child had been a victim of sexual violence for a long time.
He referred to the new Criminal Code, specifically Article 43, which opens the possibility that the perpetrator will not be penalized if it is proven that he committed an excusable defense that exceeded the limits due to severe mental shock. In addition, he also highlighted Article 54, which stipulates that judges must consider the perpetrator's motives, objectives, and mental attitude in imposing a sentence. Therefore, he assessed that at least the death penalty or life imprisonment is not appropriate to be applied to ED if the inner context and motives are proven relevant.
Brief Chronology: Report of Alleged Indecent Acts and ED's Arrest
The Pariaman Police arrested ED in connection with the alleged murder of F. The victim was said to have been found on the edge of a ravine in the Korong Koto Muaro area. The police stated that ED is the father of a 17-year-old teenager who was allegedly a victim of sexual violence by F.
The alleged sexual violence was reported by the victim's family to the Pariaman Police on September 23, 2025. A day after the report, F was found in critical condition, was taken to RSUD Lubuk Basung, and later died. Until now, investigators are still investigating the series of events, including the motives and psychological condition of ED at the time of the incident.
